READ: Coventry Supreme Court Special Election Ruling

Read the entire ruling by Supreme Court Justice Gilbert Indeglia ordering the town of Coventry to hold a special election to fill a vacant District 5 Town Council seat.

Supreme Court Justice Gilbert Indeglia ordered the town of Coventry to plan a special election to fill a vacant District 5 Town Council seat after an apparent Town Charter debacle that was discovered after the resignation of a council member in February.

The decision was issued late Tuesday evening.

The council seat was vacated in February after former Councilman Thaddeus Jendzejec resigned after moving out of the district.

At first, town officials were under the impression that the vacant seat could be filled by council appointment based on advice by the town solicitor.

That advice was based on the "official reporter," where the Town Charter is found, and it apparently was modified through error, "inadvertence or oversight" and was "inadvertently, incorrectly and illegally misprinted in the official reporter," according to a town court filing.

Residents Debra Bacon and Nancy Sullivan filed the suit which asked the court to order the town to hold a special election, arguing that District 5 voters deserved representation.

In the court filing, town lawyers argued that if the record of the charter was accurate, things would have been done differently back in February, but "now is now, not Feb. 28."

the town lawyers "argued". that tells me they are not looking after the interests of the town (ie. we the people), they are looking after the interests of liberal control of the council. they well know that a conservative would win by a landslide and there would be conservative control. any level headed lawyer would have said, there is a mistake so lets correct it the way things should have been. also, any lawyer worth their salt would have noticed the mistake immediately. hell, a normal citizen spotted it pretty quick and they didn't even have to pass a bar exam. i would think a search for competent counsel is in order.

yea CT2, you wouldn't want the taxpayers to vote and the will of the people to come to fruition. that would be horrible!

There are more clerical errors, misinterpretation, and mistakes from this town council/government it makes the RI state government look good. Not to mention the way the town council hides there head in the sand and let's part of the town get totally screwed. This has got to be one of the worst governments in this state. Oh I'm sorry I didn't realize there should be a rep for that part of town, well it's to late now so you people will just have to be screwed until November. The hell with those tax payers. Thats the coventry way.
